In Variscite NY Four, Inc. v. New York, the Second Circuit suggested states can’t dodge constitutional scrutiny just because cannabis remains illegal under the Controlled Substances Act. If you build a commercial market, you may have to play by interstate rules.


But the United States Court of Appeals for the Ninth Circuit recently signaled the opposite — arguing there may be no protected interstate cannabis commerce at all.
