New Rules. New Market. Could Liquor Stores Sell THC Drinks in New York?

By Justice

New York might be preparing for another shift in the cannabis industry — and this one could land in the beverage aisle.

A proposal moving through the New York State Legislature would allow licensed liquor and wine stores to sell low-dose THC beverages. If passed, this would mark a significant expansion beyond dispensaries, potentially placing cannabis drinks alongside wine, spirits, and craft beer.

Let’s break down what that actually means.

What’s Being Proposed?

The legislation would permit liquor stores to sell cannabis-infused beverages containing limited amounts of THC — typically around 5mg per serving. These products would remain restricted to adults 21+ and would require additional licensing and compliance measures for participating retailers.

Right now, THC drinks in New York can only be sold through licensed cannabis dispensaries. This proposal changes that distribution channel — not the age restrictions, not the compliance requirements, and not the regulatory oversight.

Why Cannabis Beverages?

Cannabis drinks are one of the fastest-growing categories in the industry. Consumers are increasingly choosing beverages for:

• Measured dosing

• Smoke-free consumption

• Social settings

• Familiar format (like seltzers or cocktails)

For many adults, a 5mg THC seltzer feels more approachable than a pre-roll or edible. It’s discreet. Controlled. Predictable.

Sound familiar?

What This Means for NYC

If liquor stores gain access to THC beverages, the cannabis market becomes more normalized — and more competitive.

Wider retail access could:

• Increase consumer awareness

• Expand brand competition

• Push innovation in beverage formulations

• Raise new compliance questions

It also blurs a cultural line that’s existed for decades — alcohol on one shelf, cannabis in another space entirely.

New York has always been a market leader. If this passes, it could influence how other states approach THC beverage regulation nationwide.

The Bigger Conversation

This isn’t just about drinks. It’s about distribution power.

Who controls shelf space?

Who controls consumer access?

How do regulators maintain safety and education while expanding availability?

Legal markets were designed to create structure — lab testing, age verification, tax revenue, accountability. If access expands, those guardrails matter even more.

At Elevated Club NYC, we believe education is elevation. Whether cannabis stays in dispensaries or moves into broader retail channels, informed consumers win.

Where Things Stand

The proposal is still under review. Nothing has changed yet. Liquor stores cannot currently sell THC beverages under New York law.

But the conversation is happening — and in this industry, conversations often turn into policy.

New rules. New market.

We’re watching closely.
